Terms of Service

These Terms of Service govern your access to and use of Tailwaters. By using Tailwaters, you agree to these Terms.

Use of Tailwaters

Tailwaters provides fly-fishing, river, dam, map, weather, notification, and safety-context information for planning and general awareness. You are responsible for your own judgment, safety, equipment, travel decisions, and compliance with laws, regulations, posted notices, and local conditions.

Safety Information

Tailwater rivers and hydropower releases can change quickly. Tailwaters may display generated, estimated, public-source, third-party, delayed, incomplete, or illustrative information. The app is not an official warning system and is not a substitute for emergency services, dam operators, official agency notices, posted signage, local guides, personal observation, or conservative river judgment.

Push notifications, weather alerts, in-app alert banners, source links, forecast wadeable windows, and rising-water alerts are informational only. They may be delayed, unavailable, duplicated, incomplete, or wrong, and they may not reflect sudden dam operations, weather, road, access, or river changes.

Do not rely on Tailwaters as your only source of safety information. If conditions look unsafe, leave the water and follow official instructions.

Accounts and Authentication

Tailwaters no longer offers consumer registration or login. To keep saved preferences and other user-specific features private, Supabase Auth automatically creates a technical anonymous guest identity with a random user ID and protected session. You do not create or enter login credentials for this identity.

The guest session is intended to preserve the same random user ID across ordinary app restarts and updates, but it is device-bound and may be unrecoverable after app-data clearing, uninstallation, session loss, or use on another device. A valid session created by an earlier Tailwaters version may remain active on the device so existing saved data is not abruptly lost.

Location and Maps

Tailwaters can use foreground device location, approximate IP-based location, and manually selected river spots to estimate your river position and tailor backend responses. Location-derived labels, map markers, access points, route lines, distance calculations, and safety context are approximate and may be wrong. You must verify your actual position and conditions before making fishing, boating, or wading decisions.

On supported devices, Tailwaters may refresh the selected dam's live/hourly feed in the background so cached data is more current when you reopen the app. Background refresh does not make Tailwaters a monitoring service or emergency alert system.

Third-Party Services and Content

Tailwaters uses third-party services and SDKs to operate the app and website, including Supabase, Firebase, Firebase Cloud Messaging, Google Maps, App Store distribution, Google Play distribution, Geolocator/operating-system location services, operating-system background task scheduling, secure platform storage, SharedPreferences/local device storage, an SMTP email delivery provider, Flutter Custom Tabs, and iOS Safari view controller browser sheets. A server-side Meta callback remains available only to process deletion requests for legacy Facebook-linked Tailwaters accounts; the current app does not offer Facebook or other social sign-in.

Tailwaters backend data may come from public or third-party sources including USACE CWMS data, USGS NWIS data, National Weather Service APIs and alerts, Southwestern Power Administration/energy.gov generation information, AGFC regulation monitoring, and ipapi.co approximate IP location fallback. The app may also link to or display reference material from AGFC, USACE, USGS, National Weather Service, Southwestern Power Administration, Google Drive-hosted documents, and Wikimedia-hosted images. We do not control and are not responsible for third-party services, maps, app stores, identity providers, public data sources, linked websites, availability, accuracy, or content.

Account Deletion

The in-app menu includes Delete Account & Data. Tailwaters verifies your active session and deletes your Supabase Auth user and associated account data. If you continue using the app, Tailwaters creates a new unrelated guest account. Signed deletion requests sent when a legacy user removes Tailwaters through Facebook delete the Supabase account associated with that Facebook identity. See Account and Data Deletion for instructions. Deletion may not immediately remove operational logs, analytics, crash reports, backups, provider records, or information that must be retained for legal, security, or operational reasons.

Acceptable Use

You agree not to misuse Tailwaters, interfere with the app's operation, attempt unauthorized access, scrape or overload services, bypass security controls, reverse engineer non-open-source portions of the app, misrepresent your identity, or use the app in a way that violates applicable law or infringes the rights of others.

We may restrict or suspend access when reasonably necessary to protect Tailwaters, its users, its providers, or the public, or when these Terms are materially violated.

Intellectual Property

Tailwaters, including its name, branding, design, app experience, and original content, is owned by us or our licensors. App store badges, maps, public-source material, and third-party logos, data, and services remain the property of their respective owners. You may not copy, distribute, modify, or create derivative works from Tailwaters except as allowed by law or with our written permission.

Disclaimer

Tailwaters is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the app, website, maps, account system, telemetry, links, data, forecasts, generated readings, push notifications, weather alerts, safety context, or third-party services will be uninterrupted, secure, accurate, complete, current, or available at any particular time.

Service Changes

We may add, change, suspend, or remove features, data sources, providers, supported tailwaters, or access methods as Tailwaters evolves. When a change materially affects our privacy practices, we will update the Privacy Policy and provide any additional notice required by law.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, personal injury, property damage, lost profits, lost data, loss of goodwill, or other losses arising from your use of or reliance on Tailwaters.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the provisions above may not apply to you. In those jurisdictions, liability is limited only to the extent permitted by law.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and provide any additional notice required by law. Continued use of Tailwaters after changes take effect means you accept the updated Terms.
